Post-Study Workers UK

If you have recently finished studying in the UK then you may be able to apply for a Tier 1 (Post-Study Work) visa. This will give you two years to live in the UK and work in whatever job you want to do. If you are a post-graduate worker or post-study worker, our immigration barristers & lawyers can assist you with visa applications, visa appeals & all aspects of UK immigration law.

You will have to meet the following legal requirements:

  • You have been awarded a Bachelor’s Degree, a Postgraduate Degree, a Postgraduate Certificate in Education or a Higher National Diploma from Scotland; and
  • You studied for this qualification at a university or college that is recognised by the UK Border Agency; and
  • While you were studying for the qualification, you had status in the UK as a Tier 4 student, a student, a student nurse, a student re-sitting an exam, a student writing up a thesis or a dependant of someone else; and
  • You are applying within a year of the date that you were told in writing that you had obtained the qualification; and
  • You have enough money to support yourself. The amount of money that you have to show will depend on how long you have been in the UK.

Your spouse, civil partner, unmarried partner and / or children may also be able to apply as your dependents.

The UK Border Agency changes the requirements of the Points Based System regularly and if you are refused leave to remain under the Points Based System and you appeal, you will only be able to rely on evidence that you submitted with your original application; you cannot introduce new evidence. It is therefore important that any application for a Tier 1 (Post-Study Work) visa is prepared carefully.
